Continental Promotion Group, Inc. Obtains Preliminary Injunction in Non-Competition Lawsuit Against Samuel Garvin, Rita Garvin and Garvin Promotion Group    (.doc // 32k)

Tempe, AZ May 12, 2008 - Continental Promotion Group, Inc. (CPG) announced today that the U.S. District Court for the District of Arizona has granted CPG's Application for Preliminary Injunction and issued an Order requiring Samuel Garvin to abide by the terms of the Stock Purchase Agreement and Consulting and Non-Competition Agreement that he signed in 2005. Under the Agreements, Garvin promised not to compete with CPG, which he sold to CPG Marketing, Inc. during 2005, or to solicit CPG's customers or employees for a period of three years following the sale. Under the Court's Order, which was issued on May 7, 2008, Garvin may not, per the terms of the Agreements, engage in the business of processing and fulfilling rebates, gift cards and other promotional items; solicit for employment or hire current or former employees of CPG or solicit current or former clients of CPG.

The Order also prohibits Garvin Promotion Group, LLC, Giftcard Loyalty Reward Solutions, LLC, and other companies owned or controlled by Samuel and Rita Garvin, from processing and fulfilling rebates, gift cards and other promotional items during the remainder of the post-sale restriction.

In its ruling, the Court stated that "[t]here is no question that Plaintiffs' have shown a likelihood of success on the merits" with respect to a breach of the non-competition provisions of the Agreements.

The Order was entered in connection with CPG's pending lawsuit against Samuel Garvin, Rita Garvin and Garvin Promotion Group (Case No. CV-08-0070-PHX-SRB) for violation of the Agreements' non-competition and non-solicitation provisions. CPG was previously granted a temporary restraining order against Mr. Garvin in the case.

Summer 2007 - Santa Ana, Calif. — In an effort to educate consumers on various aspects of paint performance, BEHR Paints announced the results of their three-month "BEHR Challenge" campaign and sweepstakes. The promotion ran from April 23 to July 31 at The Home Depot Stores nationwide and offered a chance to win up to $25,000 in gift cards from The Home Depot.

Supported by television, radio, and in-store advertising as well as live in-store demonstrations, the "BEHR Challenge" featured BEHR's Premium Plus Interior Flat Enamel compared side-by-side against a leading competitor brand in four key areas: whiteness, color clarity, durability (scrub test), and value (average retail price of products).
